What Happens During a Divorce?

The process of divorce in the state of California is as follows.

• It begins with a spouse filing for a divorce and then the petition must be served to the other spouse.
• A response must be filed by the other spouse within 30 days. Then the two parties must share information this is what is called a discovery.
• Then there is called an Order to show cause, this is when the parties need the court to interject in cases of child custody for example.

After discovery a spouse will proceed with the trial and a Mandatory Settlement Conference will be called before trial. This is an attempt to settle issues before the case is taken to court. The case is then brought to trial where the attorneys present their evidence. The judge then resolves all other outstanding issues and then signs the divorce papers, and six months later the divorce is final.
